deeper. There was never any question as to whether a law firm could copyright a cease and desist letter. The question was whether all cease and desist letters were copyrighted hot off of the presses. The answer is no. A law firm has to actively register the letter before it is sent to make it copyrighted material, and if the recipient posts it on the internet without it being registered then it is protected speech under the first amendment and the recipient cannot be sued.
This all stemmed from an incident dealing with a cease and desist letter received by infomercialscams.com from a piece of shit company called directbuy. The website was a front page link here about a week or two ago. You can find the back story

Gotta say though, I fucking hate lawyers too. This is really just another case of two lawyers pissing on each other in public.
