The way I read it, what's being discussed is threatening speech, e.g., 'I'm going to come to your house tonight and creep in your window and slit your fuking throat.'

If anyone has a problem with me saying that to you, then you should have thrown this hissy fit when you learned that you can't joke about bringing bombs onto an airplane or shoot the president.

The big question then becomes 'How long will it be before the lawyers expand the definition of threatening to include merely offensive or insulting?'
