car accident - depreciation reimbursement?         1177 reads

saturday my wife was sitting at a red light waiting to make a left turn. a driver came over the hill and plowed into her without braking.

she's ok, but the car is not. it's a five month old '06 honda accord. insurance is going to cover repairs ($7k) and a month of rental car. the other driver's insurance company is reimbursing us for our deductible. everything is basically taken care of at this point, but...

when we trade in our car, i expect us to get less for it. it's a honda dealer that's doing the work, which is nice. i'm worried that that doesn't really matter, though.

from what i've heard, what i'd need to do is pay someone to assess the car before and after repairs, and then have a lawyer contact their insurance company to retrieve depreciation plus costs plus fees. i would need to do this as soon as possible because they're just starting work, but i'm not entirely convinced it's worth the time/effort/frustration. does anyone have any experience with this?

depending on the damage to the vehicle the type of title may change, if it does - you are fucked -. You know how sometimes you see a relatively recent, though used, car selling for dirt ass cheap? That's because it's probably a salvage title, junk title, or a rebuilt. But seeing as how the damage is $7,000 you probably don't need to worry about this too much. The damage costs need to exceed something like 3/4 of the value of the car for your resell value to suffer... but it never hurts to consult professionals in matters of money.

Dont sign ANYTHING. The insurance companies will try and get you to sign releases ASAP. Once this is done they have no obligation to you anymore, less terms described.

Consult counsel. You'd be suprised what you are 'entitled' to.

I got fuked over royally after an accident in 2001 because I didn't employ counsel to handle the settlement for my car. Apparently they compile their "fair market value" tables in fuking Indonesia or Borneo or some shit.

Of course, I got fuked over on the settlement for my medical expenses as well, despite the fact I had a lawyer for that. Every 6 months or so, I'm still getting a $3600 bill for an MRI. I keep directing them to the insurance company of the woman that hit me, but they still don't get it after 5 years.

Better with than without counsel, nonetheless.
