Moar Time To Swarm?

Let me preface this by saying:

meep!


I was informed after a closed-door board meeting last night that I will be laid off beginning August 2. In their magnanimity, the BOD chose that date so that my family would be covered under my health insurance for all of August. That's small meeping consolation, Mr. President!

The meeping morons running this show couldn't find their way out of a paper bag with two hands and a flashlight. Finances in non-profits are always difficult, but the issue as to whether to lay off the staff was brought before the board MONTHS AGO. Yet in their complete ineptitude, these board members have shirked their fiduciary responsibilities and allowed the organization's cash reserves to dwindle and the staff go unpaid while they engage in petty personal vendettas against one another.

Complicating matters further (as if they needed to be) is the fact that I was injured at work a couple of months ago and now face the very real possibility of having back surgery. So if the BOD thinks its going to avoid a workers' comp claim by furloughing me, they're in for one rude meeping awakening. I've already got a lawyer ready to eat their lunch for them if they're stupid enough to pull that transparent stunt.

This is all, bad, bad stuff. My wife works full time at a temp job with no benefits and I'm facing an extended convalescence. I've been looking for another job--in fact I have an interview on Monday. But I wonder if I could accept a new job in good conscience knowing that I might need back surgery?

These idiots are not going to meep my family! I will not allow it! I have worked like a niger for seven months to keep this operation running and put up with an indescribable amount of bullmeep from every direction in doing so. They will give me everything they're obligated to or I will crush them with a legal hammer blow they will not recover from!

...

Anyway, it looks like I'll have more Swarm time coming, which is a good thing.

who were you informed by? have you received official notification of lay-off?

if not...

get up and walk to a spot where lots of people can se you and FALL. fall hard and don't get up. be carried out by an EMS crew. they can't be stupid enough to lay you off while you're out at emergency room being treated for on the job injuries.

Dude, with any luck you'll find another job just fine - but still - it's an unneeded pain in the meep.

Sorry dude. Attorneys (IMHO) are not worth their trouble. You have to do all the work yourself so they know what forms to tell their assistants to fill out. Spend your free time at the county legal library and educate youself about the law. NOLO offers some great books of representing yourself in court. Also, I believe there is a group called The American Pro Se Association who can assist you with legal information (NOT advise, which would be against the law of course). You'll have to hit this from all angles, workman's comp, state level and federal level disability. Looking for work is kind of mandatory.....required to collect unemployment among other things. If you start waving a legal sword, keep your nose clean. In all fairness to potential employers, I would choose to mention or not mention your upcoming surgery and medical problems depending upon if you REALLY want the job or not. Legally, they cannot discriminate against you (ah, another lawsuit!).

D. Get that new job. We all know their Directors will give about as much of a meepe about you as the ones at your last job.

We had the same type of managerial meepheap at my place of employment, not long ago. It sucked. Nobody knew what to do. Managers at each others throats. Backstabbing everywhere. It was a meeped up mess.

Then, the VP of our division came in and slowly meepcanned the heap of them. One at a time. Each and every manager was replaced with a competent, experienced individual.

I've been promoted twice since the VP walked in.

BUT - You have no idea how close I was to being in your shoes. The previous managment staff saw me as nothing but trouble because I expected them to actually run the plant and be responsible for their slice of managment.

Now their elsewhere and I'm looking at a managment position.

Take your experience and go elsewhere.

Look up alternative treatments for your back. Surgery should ALWAYS be the last choice.

Take care of your family, man. They're your eternal life.

i disagree with dumbskull. definitely use an attorney. last thing you need is getting fuked on your claim/lawsuit because you forgot to dot an i or cross a t. use someone who has experience in this sort of thing.

Take the job dude. Keeping a roof over there heads and food on there plates is more important. And, I'm willing to wager that if you bring up a law suit about getting laid off while a medical condition exist they might retract there pink slip. The company I work at is notorious for doing this. But they continue with the pink slip and most of the time pay off the lawsuit. If they offer you to keep the job than remember that upper management knows your name. Good luck on your journey

Hey everyone, thanks for the words of encouragement and PMs expressing support. It's really moving to have such an outpouring, especially when y'all really don't know me. Such is the powa of Teh Swarm!

Anyway, I'm sending el presidente an email requesting certain things in writing. Let's have your opinions...did I miss anything?

To [Boss]:

I just wanted to follow up on our conversation after the Board of Directors meeting on July 14. At that time, you reported to me that the Executive Committee and the full Board had voted to lay me off effective August 2. You also stated that I would be recalled to work when our....funding became available.

As I indicated then, I would like copies of the minutes of the Executive Committee meeting and Board of Directors meeting where these decisions were made. I also specifically request in writing:

  • An official notice of layoff, including the reason for the layoff.

  • Confirmation that I will be recalled as Executive Director when our... funding is available, with full benefits reinstated

  • Confirmation that upon recall, I will receive full pay retroactive to the date of my layoff (a deferred compensation plan in the same style as the one offered to [name witheld].)

  • Confirmation my compensation will include a retroactive pay increase as per my letter of acceptance dated 12-7-04 (copy already provided to you).

I'm sure you can appreciate my desire to clarify these details. I feel I would be doing [company name] and myself a disservice if I did not. I look forward to your reply, and would be happy to discuss any questions that you might have.

Ragoo, looks good to me. Maybe you want to ask for a signed copy of these things? I could see someone doing an end-run around you by providing exactly what you ask for -- the papers, in writing, but with no signature, if you catch my drift.

I probably don't know what the meep I'm talking about.

Update: The boss called--called--me to say he would give me written confirmation of all I asked for. I said in my final email that I wanted all the domeepentation by next week.

Tomorrow I drop the bomb and tell them that I'm taking all of my vacation early. That will effectively make this Friday my last day. Nigers aint gonna meep me nohow!

very nice letter gooman. Think twice about taking the vacation early? What are the laws regarding unemployment compensation in your state? Will you be eligable immadiatly at layoff date? Do you want to take this vacation time "early" if you will still recieve lump sum compensation (could save yer meep dring rehab from surgery if you wind up there). All in all it sound like you have your proverbial ducks in a row so I should probably shut up. Good luck and Godspeed dude.

Be like my dad: Put your two weeks notice in, and take those two weeks as paid vacation while you start your new job.

Except you're already fired, so just take the vacation.
